Amazon Sued by New York Attorney General Over Workplace Conditions

New York Attorney General Letitia James has initiated legal action against Amazon, claiming deficiencies in health and safety protocols at two of its New York locations.

The lawsuit further alleges that Amazon engaged in unlawful disciplinary actions and terminations against employees who voiced concerns regarding working conditions.

Investigation Details

The investigation, launched in March of the previous year, initially centered on a Staten Island fulfillment center and a Queens distribution center.

These facilities collectively employ over 5,000 individuals, and the scope of the inquiry subsequently broadened to encompass employee firings and disciplinary measures.

According to Attorney General James, Amazon failed to adequately prioritize employee well-being during a critical period.

Amazon's Response

Prior to the Attorney General’s lawsuit, Amazon filed its own legal challenge, asserting that workplace safety falls under federal jurisdiction.

The company contends that James lacks the authority to pursue the case.

Amazon spokesperson Kelly Nantel stated the company’s commitment to employee health and safety, and disputed the accuracy of the Attorney General’s claims.

Nantel highlighted Amazon’s proactive measures and industry-leading response to the pandemic.

Specific Allegations

The lawsuit details alleged violations of New York state laws concerning cleaning and disinfection procedures, as well as contact tracing protocols.

It is also claimed that Amazon did not adjust its productivity expectations to allow sufficient time for essential hygiene, sanitation, social distancing, and cleaning practices.

Retaliation Claims

The suit specifically references the termination of Christian Smalls, who has independently filed a lawsuit against Amazon.

Warnings issued to Derrick Palmer are also cited as examples of “swift retaliatory action” taken against employees who raised complaints.

Remedy Sought

The Attorney General’s office is seeking several remedies, including:

  • Changes to Amazon’s workplace policies
  • Backpay and damages for affected employees
  • Reinstatement for Christian Smalls
  • Damages for Derrick Palmer
  • Forfeiture of profits gained through alleged illegal practices

The state aims to ensure Amazon prioritizes worker safety and complies with all applicable laws.
