According to reports from The New York Times, businesses that leverage personalized pricing are obligated to inform customers that their price is determined by an algorithm utilizing their personal information. The specific wording required is, “This price was set by an algorithm using your personal data.”
The extent to which this practice is currently implemented by online retailers remains uncertain. Uber, for instance, has begun displaying this disclosure to customers in New York, though a company representative characterized the legislation as “poorly drafted and ambiguous.” Uber maintains that its dynamic pricing is solely based on geographical location and prevailing customer demand.

A legal challenge to the law was initiated by the National Retail Federation, seeking to halt its implementation. However, a federal judge has permitted the law to proceed.
