According to a recent report published by The New York Times, Facebook is exploring the establishment of a separate advisory committee dedicated to formulating policies concerning elections. The company has allegedly contacted several policy specialists and academic researchers regarding potential participation in this group.

This committee could provide Facebook with a degree of justification for its significant decisions. It is envisioned as a means to navigate complex and often contentious issues surrounding election-related content.

Focus Areas for the Proposed Commission

The commission, as described by the Times, would potentially have the authority to offer guidance on matters such as the spread of election misinformation and the regulation of political advertising. These represent two of the most pressing policy challenges currently facing Facebook.

Plans reportedly indicate that the commission should be operational prior to the 2022 U.S. midterm elections. An official announcement regarding its formation may occur as early as this autumn.

Drawing Parallels to the Oversight Board

Facebook’s proposed election commission may be structured similarly to the Oversight Board. This board represents the company’s initial attempt at implementing quasi-independent external decision-making processes.

The Oversight Board commenced case reviews in October of the previous year. However, it wasn’t fully prepared to address the surge of election misinformation that circulated on the platform during the U.S. presidential election.

Initially, the board’s rulings were limited to content that had already been removed from Facebook. This constraint impacted its immediate ability to influence the flow of information.

Limitations of the Oversight Board’s Authority

While Facebook emphasizes the independence of the Oversight Board, it’s important to note that the company itself created the board and initially appointed its co-chairs.

The Oversight Board can establish policy precedents and issue binding moderation rulings on a case-by-case basis. However, its ultimate authority is derived from Facebook, which retains the power to disregard the board’s decisions.

Political Advantages of an External Body

An independent external body focused on election policies would likely be strategically advantageous for Facebook. The company consistently faces criticism from both the Republican and Democratic parties.

Republicans often allege that Facebook unfairly censors conservative viewpoints, while Democrats highlight the platform’s history of allowing conspiracies and political misinformation to proliferate.

Past Controversies and Decisions

The decision to temporarily suspend political advertising following the election did not satisfy either political faction. This action proved insufficient to curb the widespread dissemination of organic misinformation.

Facebook requested the Oversight Board to review its decision regarding the suspension of former President Trump. Ultimately, the board deferred the most contentious aspect of the case back to the company for resolution.
