In 2019, Facebook proactively addressed some of the privacy concerns raised by the Illinois lawsuit by disabling its automatic facial recognition tagging functionality. The feature was subsequently made opt-in, requiring users to actively consent to its use.

These cases allege violations of the same Illinois law, claiming that the companies utilized Illinois residents’ facial data to train their facial recognition systems without explicit permission.

Clearview AI, a controversial facial recognition software company, is currently facing a BIPA-based class action lawsuit within the state, despite attempts to move the case to different jurisdictions.
