Several prominent social media platforms, including Google, Facebook, Telegram, LinkedIn, ShareChat, and Koo, have demonstrated either full or partial adherence to India’s recently implemented IT regulations. This information is based on insights from two sources with direct knowledge of the situation and a government document reviewed by TechCrunch.

Details of the New Regulations

India’s new IT rules, initially announced in February, mandate that companies designate and publicly share the contact information of key personnel. These roles include individuals responsible for compliance, serving as a nodal point of reference, and handling grievance redressal to address local issues.

According to the government note and a source familiar with the matter, the companies listed above have fulfilled this specific requirement. The deadline for compliance with these new IT rules was set for this week.

Twitter’s Partial Compliance and Ongoing Concerns

Twitter, however, has not yet fully complied with the regulations. A report from New Delhi indicates that Twitter submitted information late the previous night, providing details for a lawyer from an Indian law firm as their Nodal Contact Person and Grievance Officer.

The rules stipulate that these designated officials must be direct employees of the company. This has created tension between Twitter and the Indian government.

Recent events include a visit by Delhi police to Twitter’s offices to deliver a notice regarding an investigation into the platform’s classification of tweets by Indian politicians as potentially misleading. Twitter characterized this action as intimidation and expressed concerns for the safety of its employees, while also urging the government to uphold citizens’ rights to freedom of speech.

WhatsApp’s Compliance and Legal Challenge

WhatsApp has complied with most aspects of the new rules, with the exception of the traceability requirement. A source revealed that WhatsApp has initiated legal action against the Indian government concerning this specific demand.

WhatsApp argues that complying with the traceability rule would necessitate compromising the privacy of all its users. The company maintains that tracing the originator of messages would inherently require a breach of user privacy.

Status of Other Platforms

The compliance status of Apple (and its iMessage service) and Signal remains currently unclear.

The Ministry of Electronics and Information Technology in India requested updates from social media companies regarding their compliance status on Wednesday, as initially reported by TechCrunch.

India represents a crucial international market for numerous technology companies, including Facebook and Google, both of which recognize the nation as having the largest user base.

Pakistan, a neighboring country, previously proposed similar regulations last year but ultimately withdrew them after facing unified opposition from tech giants who threatened to cease operations within the nation.
