Epic Games Seeks Fortnite Reinstatement in South Korea - New Law

Epic Games Seeks Reinstatement with Apple in South Korea
Epic Games has formally requested that Apple reinstate its Fortnite developer account specifically for the South Korean market.
This move precedes plans to relaunch Fortnite on iOS devices within South Korea, offering users a choice between Epic’s own payment system and Apple’s in-app purchase options, as communicated via a recent tweet.
New South Korean Legislation Drives the Request
The request follows the recent passage of an amended Telecommunications Business Act in South Korea.
This legislation mandates that Apple, alongside other major technology companies, permit developers to integrate their own third-party payment systems into their applications.
Epic’s Compliance with Korean Law
According to the official Fortnite Twitter account, Epic’s intention is to re-release Fortnite on iOS in Korea.
The re-release will feature both Epic payment and Apple payment options, ensuring full compliance with the newly enacted Korean law.
Apple’s Response and Concerns
Apple has stated it would welcome Epic’s return to the App Store, provided they adhere to the same rules as all other developers.
However, Apple points to Epic’s previous breach of contract and asserts there is currently no valid justification for reinstating their developer account.
Ongoing Compliance Issues
Apple also emphasizes that Epic would need to demonstrate consistent adherence to the App Store Review Guidelines for all applications.
Past behavior indicates Epic has not consistently followed these guidelines, and their current request doesn't signal a change in their stance, according to Apple.
Legislative Impact and Apple’s Discretion
Even if the South Korean legislation becomes fully effective, Apple maintains that it does not create an obligation to approve any developer program account application.
This is based on Apple’s official statement regarding the matter.
The History of the Dispute
In August 2020, Apple removed Fortnite from the App Store after Epic implemented a direct payment system within the game.
This action circumvented Apple’s standard in-app purchase requirements, initiating a protracted legal battle concerning the Apple Store’s payment policies.
Apple’s Evolving Policies
Apple is currently revising its app policies to allow developers to include links to external websites.
Furthermore, a settlement has been reached in Japan, permitting developers of “reader” apps to direct users to their own websites.
No Immediate Comment from Epic
A spokesperson for Epic Games has not yet provided a response to requests for further comment on this developing situation.
