U.K. Regulator Designates Apple and Google with Strategic Market Status
The Competition and Markets Authority (CMA) in the U.K. announced on Wednesday the designation of both Apple and Google as strategically important players within their respective mobile ecosystems. This decision impacts the companies’ operating systems, app distribution channels, web browsers, and the underlying technologies that power them. The aim is to facilitate more competitive practices within the mobile sector.
Investigations and Stakeholder Consultation
The CMA initiated investigations into Apple and Google back in January, with preliminary proposals for interventions outlined in July. These proposals suggested the potential for designating the tech giants with strategic market status (SMS). Extensive consultation was undertaken, involving over 150 stakeholders and direct engagement with both Apple and Google, before reaching a final determination.
The CMA concluded that Apple and Google possess “substantial, entrenched market power” and hold a strategically significant position within their mobile platforms.
Key Findings Regarding Market Dynamics
The CMA’s analysis revealed a low propensity for U.K. mobile users to switch between the Apple and Google platforms once they have become invested in a particular ecosystem. Furthermore, the regulator highlighted the necessity for businesses to utilize the respective app stores to effectively reach consumers.
Importantly, the CMA determined that emerging technologies, such as artificial intelligence (AI), are “unlikely to diminish Apple or Google’s market dominance” over the five-year period of the designation.
CMA’s Perspective on Competition
Will Hayter, executive director for digital markets at the CMA, stated that Apple and Google’s mobile platforms are integral to how numerous businesses operate and serve millions of customers. However, he also noted that the platforms’ existing rules may be hindering both innovation and competition.
The CMA clarified that the SMS designation does not imply any wrongdoing on the part of Apple or Google. Instead, it empowers the regulator to consider “proportionate, targeted interventions” to ensure open competition and fair treatment for consumers and businesses reliant on these platforms.
Responses from Apple and Google
Both Apple and Google have expressed disagreement with the CMA’s decision. Apple cautioned that the ruling could result in U.K. users experiencing delays in accessing new features, citing the example of Apple Intelligence. Google similarly questioned the justification for the designation.
Apple released a statement, shared with TechCrunch, which reads:
“Apple faces fierce competition in every market where we operate, and we work tirelessly to create the best products, services and user experience. The UK’s adoption of EU-style rules would undermine that, leaving users with weaker privacy and security, delayed access to new features, and a fragmented, less seamless experience. We’ve seen the impact of regulation on Apple users in the EU, and we urge the UK not to follow the same path.”
