The Evolving Landscape of Worker Rights in the Tech and Gig Economies

The economic realities shaped by the recent pandemic have underscored the vital role played by both gig workers and those employed in warehouse settings. A new law enacted in California earlier this year reclassifies gig workers as independent contractors. Simultaneously, employees at Amazon warehouses in Alabama are actively pursuing unionization to secure enhanced workplace protections.

During TC Sessions: Justice, I engaged in conversation with Vanessa Bain, co-founder and organizer of the Gig Workers Collective, Christian Smalls, founder of The Congress of Essential Workers and a former Amazon warehouse employee, and Jessica E. Martinez, Co-Executive Director of the National Council for Occupational Safety and Health. Our discussion centered on the future trajectory of gig work and the contractor workforce within the technology sector, as well as the challenges these essential workers will face moving forward.

Focus on the Amazon Unionization Effort

A groundbreaking union drive is currently underway among Amazon warehouse personnel in Bessemer, Alabama. Smalls, who experienced termination from his position at an Amazon facility in Staten Island following his advocacy for adequate personal protective equipment, shared that he recently dedicated several days to supporting the efforts in Bessemer.

Furthermore, President Biden has publicly expressed his support for the unionization initiatives in Bessemer.

The Impact of Proposition 22

The effects of Prop 22 are already being observed beyond the technology industry. Bloomberg reported that the supermarket chain Albertsons began substituting employed delivery drivers with independent contractors in December, resulting in the replacement of hundreds of California employees with DoorDash workers. Tech companies have also voiced interest in enacting similar legislation in other states.

Martinez highlighted a common misconception among California voters who supported Prop 22, believing they were bolstering worker rights and access to benefits.

Bain characterized the passage of Prop 22 as a systemic failure, reflecting a broader issue within the economic framework.

The Potential of the PRO Act

Currently before the U.S. Senate is legislation designed to streamline the process of workers organizing and forming unions nationwide. The Protecting the Right to Organize Act aims to revise labor laws to empower workers.

Bain emphasized the critical importance of enacting the PRO Act, particularly in the wake of Prop 22’s approval in California.

Martinez explained the alignment between the PRO Act and the objectives of COSH. The organization recently unveiled a national agenda for worker safety and health, accompanied by a series of recommendations.
