Tesla Deceptive Marketing: Autopilot and Full Self-Driving Ruling

Tesla Faces Scrutiny Over Autopilot and Full Self-Driving Marketing
A ruling by an administrative law judge has determined that Tesla employed marketing practices that misled consumers regarding the functionalities of its Autopilot and Full Self-Driving driver assistance systems. This represents a significant juncture in a prolonged case initiated by California’s Department of Motor Vehicles (DMV).
DMV Ruling and Proposed Penalties
The judge supported the state DMV’s request for a 30-day suspension of Tesla’s sales operations as a consequence of these actions. However, the DMV has temporarily stayed this order. Tesla now has a 60-day period to revise or eliminate any misleading language before the suspension is enacted, as reported by various news sources.
Furthermore, the judge suggested a 30-day suspension of Tesla’s manufacturing license, but this order was also stayed by the DMV, according to Bloomberg News.
DMV Director's Statement
“Today’s decision by the DMV underscores the department’s commitment to upholding the highest safety standards for all vehicles, ensuring the protection of California’s drivers, passengers, and pedestrians,” stated DMV director Steve Gordon. “Tesla has the opportunity to avert this decision and resolve the issue definitively—a step that autonomous vehicle companies and other automakers have successfully taken within California’s innovative environment.”
Tesla's Response
In a post on X, Tesla asserted that “Sales in California will continue uninterrupted.”
The company characterized the ruling as a “consumer protection” order centered on the use of the term ‘Autopilot,’ despite the absence of any customer complaints regarding issues with the system.
Appeals Process and Compliance
Following the 60-day period, Tesla retains the right to appeal the decision. Should Tesla demonstrate compliance, the proposed suspensions will be rescinded. However, the specific actions the DMV requires from Tesla, beyond addressing its use of the term ‘autopilot,’ remain unclear.
The DMV has not yet responded to requests for further clarification, or to inquiries regarding Tesla’s stated intention to disregard the ruling.
Ongoing Investigations
Tesla is currently subject to multiple investigations by the California Attorney General, the Department of Justice, and the Securities and Exchange Commission. These investigations concern similar allegations of misleading marketing practices related to its partial autonomy systems. The company has also resolved several civil lawsuits stemming from crashes involving its Autopilot technology.
Background of the Case
The case initiated by the CA DMV has been progressing through the state’s Office of Administrative Hearings for several years. The agency alleges that Tesla led customers to believe its advanced driver assistance systems possessed a higher level of autonomy than they actually do.
This perceived overconfidence in the systems, the DMV contends, has contributed to numerous accidents and fatalities. Tesla countered these claims by asserting its marketing is protected under free speech principles.
Potential Impact of Suspensions
A temporary suspension of sales in California could significantly impact Tesla’s business, given the state’s position as its largest U.S. market. A manufacturing suspension would also pose challenges.
While Tesla has established a substantial factory in Austin, Texas, and relocated its headquarters there, its Fremont, California facility remains crucial for producing hundreds of thousands of vehicles, including all North American-bound Model 3 sedans.
Robotaxi Service and Recent Developments
The judge’s decision coincides with Tesla’s ongoing testing of its Robotaxi service in Austin. Recently, the company removed the safety monitors from its limited fleet operating in the city.
For the past six months, the vehicles have been providing rides to customers with a safety monitor present, either in the driver’s or passenger’s seat. CEO Elon Musk has stated that these vehicles utilize a different software version than that available to standard Tesla customers.
This report has been updated to incorporate information from the DMV’s official press release and Tesla’s subsequent statement.
