Supreme Court to Hear TikTok Ban Case - Sell or Ban Law

TikTok Ban Challenge Reaches the Supreme Court

The U.S. Supreme Court has announced it will review the legal challenge brought forth by ByteDance and TikTok regarding a law that could result in a nationwide ban of the platform.

This law stipulates that TikTok must be divested from its Chinese ownership by January 19th, or face prohibition within the United States.

Arguments to be Heard in January

Oral arguments concerning the constitutionality of the sell-or-ban law, specifically its potential violation of the First Amendment, are scheduled for January 10th before the Supreme Court justices.

The timeline for a final decision from the court remains uncertain at this time.

Previous Legal Actions

ByteDance and TikTok jointly petitioned the Supreme Court on Monday seeking to halt the law’s implementation.

Prior to this, an emergency motion was submitted to an appeals court last week, requesting a temporary block to allow the Supreme Court sufficient time for case evaluation.

TikTok’s Response

“We’re pleased with today’s Supreme Court order,” stated Michael Hughes, a TikTok spokesperson, in a communication with TechCrunch.

Hughes further expressed confidence that the Court will determine the TikTok ban to be unconstitutional, thereby preserving the free speech rights of the platform’s 170+ million American users.

Potential Support from President-Elect Trump

TikTok may also receive support from incoming President Donald Trump, who has publicly stated his intention to preserve access to the platform.

Reports from CNN’s Kaitlan Collins indicate that TikTok CEO Shou Chew met with President-elect Trump at Mar-a-Lago on Monday.

This meeting suggests a potential shift in the administration’s stance towards TikTok.
