SpaceX Faces Lawsuit Alleging Discrimination and Security Protocol Violations
A former security manager at SpaceX has initiated legal action against the company and a senior employee, alleging instances of discrimination, sexual harassment, and retaliatory behavior.
Jenna Shumway, who joined SpaceX in 2022 and was subsequently promoted to senior contractor program security officer, claims that Daniel Collins, a former Department of Defense official overseeing security compliance, disregarded established top secret protocols.
Allegations of Security Breaches
The lawsuit further asserts that Collins actively concealed these breaches from relevant government authorities. Legal representatives for Shumway, Collins, and SpaceX have not yet issued a response to inquiries from TechCrunch regarding these claims.
Reports surfaced in December 2024, as detailed by The New York Times, indicating that SpaceX was under federal scrutiny due to perceived deficiencies in its security measures. The NYT reported Collins allegedly discouraged the reporting of security clearance violations.
Furthermore, it was alleged that individuals lacking the necessary security clearances were permitted to attend classified meetings. These concerns prompted at least three separate federal reviews of SpaceX’s security procedures, according to the NYT investigation.
Details of the Discrimination Claims
According to Shumway’s filed complaint, she was bypassed for a director-level position that was ultimately filled by Collins, without even being offered the opportunity to apply.
Her work environment underwent a significant negative shift following Collins’ appointment as her supervisor in the spring of 2024. Shumway contends that Collins initiated a pattern of harassment against her.
This harassment reportedly involved a gradual removal of her responsibilities over several months, culminating in her termination in October 2024.
Allegations of Harassment Towards Multiple Employees
The complaint details allegations that Collins’ harassing behavior extended to other female employees within the organization.
Instances of alleged discrimination included obstructing female staff from completing essential security tasks, potentially creating situations of noncompliance, and inappropriate behavior during meetings.
Specifically, the complaint cites an instance of Collins staring at an employee’s chest during a meeting and making an inappropriate suggestion to a subordinate regarding after-work drinks.
Lack of Response to Reported Complaints
Shumway and other female employees reportedly brought these concerns to the attention of SpaceX’s human resources department on multiple occasions.
The lawsuit alleges that the company failed to take substantive action in response to these complaints, offering only the suggestion that employees avoid being alone with Collins.
Shumway is seeking unspecified financial damages as a result of the alleged misconduct.
Previous Lawsuits and Ongoing Investigations
This is not the first instance of SpaceX facing legal challenges related to allegations of sexual discrimination. Prior lawsuits have presented similar accounts of bias against female employees and a work environment conducive to gender-based harassment.
Currently, the company is also contending with investigations initiated by the California Civil Rights Department and the National Labor Relations Board concerning comparable claims.
Legal Proceedings
The lawsuit was initially filed in late May within the Los Angeles County Superior Court.
Subsequently, at SpaceX’s request, the case was transferred to federal court on June 30th. The case is currently registered in the federal Central District of California under case number 2:22-cv-05959.
