Uber has achieved a positive result in legal proceedings in the Netherlands, its European headquarters, concerning allegations that its algorithms are used to terminate driver contracts. The court ultimately dismissed these claims.
Furthermore, the ride-hailing company has largely succeeded in limiting the scope of data requests from drivers seeking access to their personal information held within Uber’s systems.
Drivers' Data Access Requests and Collective Bargaining
Last year, a group of Uber drivers initiated lawsuits, supported by the App Drivers & Couriers Union (ADCU), with the intention of transferring data held on the Uber platform to a data trust – the Worker Info Exchange. This trust, administered by a union, aims to strengthen their collective bargaining position against the platform.
The court acknowledged the drivers’ right to seek data, stating that this purpose doesn’t conflict with exercising their personal data access rights. However, it rejected many specific requests, citing issues of generality, insufficient explanation, or the need to balance against other rights, such as passenger privacy.
Despite this, the court mandated Uber to release a limited amount of additional data to the drivers involved in the litigation. While access to manual notes, tags, and reports was denied, Uber must provide anonymized rider ratings within two months.
Automated Dispatch and Data Format
A significant win for Uber was the court’s determination that its automated dispatch system does not constitute a “legal or similarly significant effect” for drivers under EU law. This allows for continued application of the system without mandatory human oversight.
The court also ruled that providing data in PDF format, as Uber currently does, is sufficient to meet legal requirements, rejecting the request for CSV files or API access.
An Uber spokesperson provided a statement regarding the judgements.
ADCU Response and Potential Appeals
The ADCU stated that the litigation confirms that collective action to access data is not an abuse of data protection rights. They also welcomed the court’s order for Uber to release more data.
The union indicated potential grounds for appeal, expressing concern that certain aspects of the judgements may unduly restrict drivers’ rights, potentially hindering their ability to validate fares and compare earnings.
“We also feel the court has unduly put the burden of proof on workers to show they have been subject to automated decision making before they can demand transparency of such decision making,” the ADCU added. “Similarly, the court has required drivers to provide greater specificity on the personal data sought rather than placing the burden on firms like Uber and Ola to clearly explain what personal data is held and how it is processed.”

Ola Litigation and Similar Rulings
The Amsterdam court also issued a ruling in similar litigation against India-based Ola, ordering the company to provide a broader range of data and explain the criteria for its ‘penalties and deductions’ algorithm.

James Farrar, director of the Worker Info Exchange, commented: “This judgment is a giant leap forward in the struggle for workers to hold platform employers like Uber and Ola Cabs accountable for opaque and unfair automated management practices. Uber and Ola Cabs have been ordered to make transparent the basis for unfair dismissals, wage deductions and the use of surveillance systems.”
Update: In a call with TechCrunch, Farrar clarified that numerous Article 22 cases against Uber remain outstanding, concerning different types of terminations. He emphasized that this ruling applies to a specific set of cases and that many more involve potentially fully automated decisions without human intervention.
“I am really heartened by the Ola case where automated decision-making was identified. Because I think that is more analogous to the types of automated firings that Uber has been doing than what were decided today.”
The core challenge with automated decision-making lies in the difficulty for those affected to gain full transparency regarding the data and processes involved, making it hard to assess fairness.
Jill Toh, a researcher at the University of Amsterdam, stated: “It has shown that drivers are still insufficiently able to obtain sufficient data and/or a more comprehensive understanding of their work and how they are algorithmically managed. The one good point of the judgment is that Uber’s claim that workers are abusing the GDPR was not granted.”
“In some parts where the court rejected workers request for access to data, the court’s explanation is that workers are not specific enough to the exact claims of their personal data, yet it is precisely because they do not know what specific data is being captured of them that they need this access,” Toh continued. “Another irony is that in the robo-firing case, one of the alleged fraudulent actions by drivers (related to trip fraud), is the use of software to game Uber system’s by attempting to pick their rides. It’s clear that these tactics and strategies are aimed to gain more control over their work. Both judgments have shown that workers are still a long way from that. What is also evident is that workers are still unprotected by unfair dismissal, whether by an algorithm/automated decision-making system or by humans.”

Court Finds No Evidence of ‘Robo-Firings’ by Uber
A recent legal challenge alleging Uber engaged in ‘robo-firings’ has been dismissed by the court. Applicants in the case claimed a violation of their rights concerning automated decision-making during account terminations, alongside failures to meet transparency requirements as outlined in GDPR Articles 13, 14, and 15.
GDPR Article 22 grants EU citizens the right to avoid decisions based solely on automated processing, including profiling, when such decisions carry significant legal consequences. For a decision not to be considered fully automated, it must involve substantial human oversight and interaction.
Uber maintained that it does not implement automated driver terminations within the region, asserting the GDPR does not apply to their practices. The company stated that potential fraudulent activities are investigated by a dedicated team – the ‘EMEA Operational Risk team’.
While acknowledging the use of software to detect potential fraud, Uber emphasized that investigations are conducted by employees. These employees adhere to established internal protocols, analyzing signals and relevant circumstances to validate or dismiss suspected fraud.
Uber explained that terminating a driver due to consistent fraudulent behavior requires unanimous agreement from two members of the Risk team. In instances of disagreement, a third team member conducts a further investigation to reach a final determination.
The company furnished the court with detailed explanations for each applicant’s termination. The court noted that Uber’s account of its decision-making process was not contested. Consequently, the court accepted Uber’s explanation as accurate in the absence of contradictory evidence.
In one specific case, Uber informed the court that an applicant had utilized (unspecified) software to manipulate the Uber Driver app. This manipulation allowed the driver to view passenger destinations before accepting rides, facilitating the selection of more profitable journeys – a practice prohibited by Uber’s terms of service.
The driver received a warning regarding potential termination if the software was used again. However, subsequent use of the software triggered another investigation and ultimately, account termination.
It is important to note that the alleged activity occurred in 2018. Since then, Uber has modified its service to provide drivers with destination information prior to ride acceptance. This change was implemented following a UK Supreme Court ruling recognizing drivers as workers rather than independent contractors.
Concerns Regarding Transparency Have Been Identified
Regarding the question of whether Uber fulfilled its obligations concerning transparency towards drivers whose services were terminated, the court determined that, in the instances of two out of four applicants, Uber had not. However, this was not the case for the remaining two.
The court stated, “Uber failed to specify the precise fraudulent activities that led to the deactivation of their accounts.” This applied to the two applicants who were deemed to have not received adequate information regarding their terminations.
Further clarification from the court indicated that, “Based on the information supplied by Uber, these applicants are unable to ascertain which personal data was utilized during the decision-making process resulting in their account deactivations.”
Consequently, the decision to deactivate their accounts lacked sufficient transparency and verifiability. Uber is now required to grant applicants 2 and 4 access to their personal data, as stipulated by Article 15 of the GDPR.
This access must be provided in a manner that allows them to validate the accuracy and legality of their data processing.
Uber’s attempt to avoid disclosure, based on the argument that providing further information would reveal details of its anti-fraud detection systems and potentially allow circumvention, was dismissed by the court.
The court reasoned: “Under these circumstances, Uber’s interest in denying access to the processed personal data of applicants 2 and 4 does not supersede their right to access their personal data.”
Claims for compensation related to the allegations were denied, even in the cases of the two applicants who did not receive sufficient data concerning their terminations.
The court explained this was due to the applicants failing to demonstrate “grounds for damage to their reputation or harm to their person in any other manner.”
Uber has been granted a two-month period to provide the two applicants with the personal data relevant to their terminations. No financial penalty has been imposed at this time.
The court expressed confidence that, “For the present, it is reasonable to expect that Uber will willingly adhere to the order for data inspection and will make efforts to furnish the pertinent personal data.”
