Disney Cease and Desist: Google Faces Copyright Infringement Claim

Disney Issues Cease-and-Desist to Google Over Copyright Infringement
On Wednesday, The Walt Disney Company formally requested that Google halt alleged copyright violations, as reported by Variety. This request was delivered in the form of a cease-and-desist letter.
Allegations of Large-Scale Copyright Infringement
Disney contends that Google is engaging in copyright infringement on a substantial level. The company asserts that Google’s AI models and associated services are being utilized to distribute unauthorized images and videos for commercial gain.
According to the letter, Google functions as a platform for the widespread reproduction and distribution of Disney’s copyrighted material. It states that Google is capable of creating and disseminating copies of Disney’s characters and works at a significant rate.
Furthermore, the letter highlights that many of the images generated by Google’s AI services bear the Google Gemini logo. This branding, Disney argues, falsely suggests that Google’s use of Disney’s intellectual property is both authorized and endorsed by Disney itself.
Characters Affected by Alleged Infringement
The cease-and-desist letter specifically names characters from several popular Disney franchises as being impacted by Google’s alleged infringement. These include characters originating from “Frozen,” “The Lion King,” “Moana,” “The Little Mermaid,” and “Deadpool.”
Google’s Response
Google has not directly confirmed or denied the claims made by Disney. However, a spokesperson indicated the company intends to continue discussions with Disney.
The spokesperson stated that Google and Disney have a long-standing, mutually advantageous relationship. They also noted that Google utilizes publicly available data from the internet to develop its AI technologies.
Additionally, Google highlighted its existing copyright control mechanisms, such as Google-extended and Content ID for YouTube. These tools are designed to provide content owners with control over their intellectual property.
Disney’s Partnership with OpenAI
This action against Google occurred concurrently with a significant announcement from Disney. The company revealed a $1 billion, three-year agreement with OpenAI.
This collaboration will integrate Disney’s iconic characters into OpenAI’s Sora AI video generator. This partnership demonstrates Disney’s proactive approach to leveraging AI technology while protecting its intellectual property.
